Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Calcutta Chamber of Trade member directory portal at https://calcuttachamberoftrade.com (the "Portal"), operated by the Calcutta Chamber of Trade ("CCT", "we", "us").
By accessing or using the Portal — as a visitor, a registered member, or an administrator — you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Portal.
These Terms are governed by the laws of India, including the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023.
1. Definitions
- "Portal" — the website at https://calcuttachamberoftrade.com and all its pages, APIs, and member-facing features.
- "Member" — a business or individual holding a valid CCT membership (Regular, Online, or Life) with an active account on the Portal.
- "Visitor" — any person who accesses the Portal without a registered account.
- "Administrator" — CCT staff authorised to manage the Portal, approve content, and administer memberships.
- "Content" — any text, images, files, product listings, or other material submitted to or displayed on the Portal.
- "Catalogue" — product or service listings uploaded by a Member to their directory profile.
2. Eligibility and Account Registration
- The Portal is intended for use by businesses and individuals engaged in trade, manufacturing, or related services in India. You must be at least 18 years old to register.
- Member accounts are created by CCT administrators upon acceptance of a membership application. You cannot self-register without a valid membership.
- You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with any other person.
- You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
- CCT reserves the right to suspend or terminate any account that violates these Terms.
3. OTP Login and Authentication
- Login requires your registered email address, the shared Chamber password, and a one-time password (OTP) sent to your email.
- OTPs expire after 15 minutes and are single-use. You have 5 attempts per 15-minute window before your account is temporarily rate-limited.
- Administrator accounts bypass the OTP step and are protected by a separate credential layer.
- You are responsible for the security of your email account. CCT is not liable for unauthorised access resulting from a compromised email account.
4. Member Directory Listing
- Your business profile — including name, address, phone, website, GST number, trade type, products, and description — is publicly visible on the Portal and may be indexed by search engines.
- By submitting your profile information, you grant CCT a non-exclusive, royalty-free licence to display that information on the Portal for the duration of your membership.
- You warrant that all information you provide is accurate, complete, and not misleading. You must keep your profile up to date.
- Profile edits are subject to review and approval by CCT administrators before going live. Approved changes typically take 1–2 working days.
- CCT reserves the right to edit, withhold, or remove any listing that is inaccurate, misleading, offensive, or in breach of these Terms.
5. Catalogue Uploads
- Members with an active advertisement tier (Gold, Silver, or Bronze) may upload product or service catalogue items within their tier's slot limit (Gold: 4, Silver: 2, Bronze: 1).
- Catalogue additions and edits are subject to admin review before going live (1–2 working days). Deletions take effect immediately.
- Each uploaded file must be under 5 MB. Accepted formats are images (JPEG, PNG, WebP) and PDFs.
- You must own or have the right to use all images and content you upload. Do not upload material that infringes any third party's intellectual property rights.
- You must not upload content that is obscene, defamatory, fraudulent, or otherwise unlawful under Indian law.
- CCT may remove any catalogue item at its discretion without prior notice if it violates these Terms.
6. Membership Fees and Payments
- Membership fees are as published on the Membership Plans page and are subject to change with reasonable notice.
- Payments are processed securely by Stripe. CCT does not store your card details.
- Fees are non-refundable except where required by applicable law or at CCT's sole discretion in exceptional circumstances.
- Membership lapses automatically if renewal fees are not paid by the due date. A lapsed membership results in your listing being removed from the public directory.
- All prices are in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.
7. Prohibited Conduct
You must not:
- Use the Portal for any unlawful purpose or in violation of any applicable Indian law.
- Attempt to gain unauthorised access to any part of the Portal, the database, or any other member's account.
- Scrape, crawl, or systematically extract data from the Portal without CCT's prior written consent.
- Submit false, misleading, or fraudulent business information.
- Impersonate any person, business, or CCT official.
- Transmit any virus, malware, or other harmful code.
- Use the Portal to send unsolicited commercial communications (spam) to other members.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Portal.
- Use automated tools to submit membership applications or login attempts beyond normal use.
8. Intellectual Property
- The Portal's design, code, branding, logo, and original content are the intellectual property of the Calcutta Chamber of Trade and are protected under Indian copyright law.
- Member-submitted content (profile text, catalogue images) remains the intellectual property of the respective member. By submitting it, you grant CCT the licence described in Section 4.
- The CCT name, seal, and logo may not be used by any member or third party without prior written permission.
9. Disclaimer of Warranties
The Portal is provided "as is" and "as available" without warranties of any kind, express or implied. CCT does not warrant that the Portal will be uninterrupted, error-free, or free of viruses. CCT does not verify the accuracy of member-submitted business information and is not responsible for any reliance placed on directory listings by visitors or other members.
10. Limitation of Liability
To the maximum extent permitted by applicable Indian law, CCT shall not be liable for any indirect, incidental, special, or consequential loss or damage arising out of or in connection with your use of the Portal, including but not limited to loss of business, loss of profits, or loss of data. CCT's total aggregate liability to any member shall not exceed the membership fee paid by that member in the 12 months preceding the claim.
11. Termination and Suspension
- CCT may suspend or terminate your account and remove your listing at any time if you breach these Terms, without prior notice and without liability.
- You may request closure of your account by emailing [email protected]. Your public listing will be removed within 5 working days. Certain data may be retained as required by law (see our Privacy Policy).
- Termination of your account does not affect any accrued rights or obligations.
12. Third-Party Links and Services
The Portal may contain links to member websites and third-party services (e.g. Stripe for payments). CCT is not responsible for the content, privacy practices, or reliability of any third-party website or service. Links do not constitute an endorsement by CCT.
13. Amendments
CCT may amend these Terms at any time. The effective date at the top of this page will reflect the most recent revision. For material changes, registered members will be notified by email. Continued use of the Portal after the effective date constitutes acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably by contacting CCT at [email protected]. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal.
